Who can submit an advice request to the Council?

Government via the Cabinet of the Governor and Parliament directly. The Council can also render an advice on its own initiative.

The processing time depends on factors such as the complexity of the underlying matter, the size of the dossier and the assigned prioritization. In general, the processing time can range from 2 weeks to 6 months.

Circumstances can warrant a request for urgent handling. This must be adequately motivated and substantiated to be honored.

The official legislative language is Dutch. Consequently, all draft legislation submitted to the Council for review is in Dutch.

An advice is not published when it contains confidential information or when the nature of the advice legally precludes publication. For the legal basis, please see the Landsverordening openbaarheid van bestuur.

The Council meets twice a month. Urgent meetings can be called when it is deemed necessary. There are also biannual extraordinary meetings with the Governor.

Yes, the Council maintains good working relationships with its counterparts within the Kingdom and meets with them every (other) year.

Regular members must be residents of Sint Maarten. Extraordinary members may live abroad but must have Dutch Nationality.
